1. Agreement to These Terms

These Terms constitute a legally binding agreement between you and Real Estate Network Inc (“Real Estate Network Inc,” “we,” “us,” or “our”) concerning your access to and use of the Services.

These Terms apply whether you access the Services as a visitor, buyer, seller, renter, landlord, tenant, property owner, real estate professional, agent, broker, service provider, or any other type of user.

Certain features, services, transactions, promotions, professional relationships, or products may be governed by additional agreements, disclosures, policies, or terms. If additional terms apply, they will be presented to you when appropriate and will supplement these Terms.

If there is a conflict between these Terms and a separate written agreement you have entered into with Real Estate Network Inc, the separate agreement will control to the extent of the conflict.

2. Real Estate Network Inc’s Role

Real Estate Network Inc may provide online tools and information intended to assist users in researching properties, connecting with real estate professionals, evaluating listings, communicating with service providers, and exploring potential real estate opportunities.

Unless expressly stated otherwise in a separate written agreement, information provided through the Services is for general informational purposes and does not constitute legal, tax, accounting, financial, lending, appraisal, inspection, insurance, investment, or other professional advice.

The availability of a property, listing, agent, lender, inspector, contractor, attorney, title company, insurance provider, or other professional through the Services does not constitute a guarantee, endorsement, recommendation, or representation by Real Estate Network Inc.

You are responsible for obtaining independent professional advice before making decisions involving a real estate transaction.

3. Eligibility and Accounts

You may use the Services only if you are legally capable of entering into a binding agreement under applicable law.

Certain Services may require you to create an account. You agree to:

• Provide accurate and complete information.
• Keep your account information current.
• Maintain the confidentiality of your login credentials.
• Notify Real Estate Network Inc promptly if you believe your account has been compromised.
• Accept responsibility for activity occurring through your account unless caused by Real Estate Network Inc’s failure to maintain reasonable security.

You may not create an account using another person’s identity, impersonate another individual or organization, or provide misleading information about your relationship with a property, listing, brokerage, or real estate professional.

4. Property Information and Listings

Property information displayed through the Services may include, without limitation:

• Property addresses.
• Listing prices.
• Property descriptions.
• Photographs and videos.
• Floor plans and virtual tours.
• Bedrooms, bathrooms, dimensions, and other characteristics.
• Property tax information.
• Historical sales information.
• Estimated values.
• Neighborhood information.
• School-related information.
• Geographic and mapping information.
• Agent and brokerage information.
• Open-house information.
• Availability and status information.

Property information may originate from property owners, agents, brokers, multiple listing services (“MLSs”), public records, data providers, government sources, vendors, or other third parties.

Real Estate Network Inc does not guarantee that property information is complete, current, accurate, reliable, or error-free.

Listings may change, be withdrawn, expire, become unavailable, change price, or be sold or leased without notice.

5. No Guarantee of Property Information

You should independently verify all information that may affect your decision to purchase, sell, lease, rent, finance, insure, or otherwise transact with respect to a property.

This includes, without limitation, square footage, lot size, room dimensions, zoning, permitted uses, property condition, structural condition, renovations, permits, taxes, assessments, HOA information, school information, environmental conditions, flood zones, utility availability, development restrictions, rental restrictions, ownership, title, liens, easements, boundaries, and property history.

You should conduct appropriate due diligence and consult qualified professionals before relying on information presented through the Services.

6. Real Estate Transactions

Real Estate Network Inc does not make any guarantee regarding the outcome of a real estate transaction.

A listing displayed through the Services does not constitute an offer by Real Estate Network Inc to sell, lease, or otherwise transfer the property.

A property inquiry, appointment request, showing request, contact form, saved search, or other interaction through the Services does not create a purchase agreement, lease, agency relationship, brokerage relationship, fiduciary relationship, or other contractual relationship unless expressly established through a separate agreement.

All offers, contracts, disclosures, agency relationships, compensation arrangements, and other transaction-specific matters are governed by the applicable agreements and laws relating to the transaction.

7. User-Submitted Content

The Services may allow you to submit, upload, publish, transmit, or otherwise provide content, including photographs, reviews, comments, property information, messages, documents, questions, and other material (“User Content”).

You retain ownership of User Content to the extent you have legally enforceable ownership rights in that content.

By submitting User Content through the Services, you grant Real Estate Network Inc a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, distribute, modify, format, adapt, and otherwise use that User Content as reasonably necessary to operate, provide, improve, promote, and secure the Services.

You represent that you have all rights, permissions, licenses, and consents necessary to submit the User Content and grant the rights described above.

You must not submit content that infringes another person’s intellectual property, privacy, publicity, contractual, or other legal rights.

8. Reviews, Ratings and Feedback

If Real Estate Network Inc permits reviews, ratings, testimonials, questions, comments, or feedback, you agree that your submission must be truthful, relevant, and based on a genuine experience.

You may not submit reviews or feedback that:

• Are knowingly false or misleading.
• Impersonate another person.
• Contain unlawful threats or harassment.
• Contain discriminatory or hateful material.
• Reveal another person’s private or confidential information.
• Are submitted in exchange for improper compensation or incentives.
• Are primarily promotional spam.
• Are unrelated to the service or experience being reviewed.

Real Estate Network Inc may remove or decline to publish content that violates these Terms or applicable law.

9. Acceptable Use

You may use the Services only for lawful purposes and in accordance with these Terms.

You agree to use the Services responsibly and in a manner that does not interfere with other users’ ability to access or use them.

10. Prohibited Activities

You may not, directly or indirectly:

• Use the Services for an unlawful purpose.
• Violate applicable federal, state, provincial, local, or international law.
• Attempt to gain unauthorized access to any account, system, network, or database.
• Interfere with or disrupt the Services.
• Introduce malware, viruses, ransomware, spyware, or other harmful code.
• Use automated systems to scrape, crawl, harvest, copy, index, or collect data from the Services without authorization.
• Use bots or automated tools to create accounts or submit inquiries without authorization.
• Copy, reproduce, republish, sell, license, distribute, or commercially exploit protected content without permission.
• Attempt to reverse engineer, decompile, disassemble, or discover source code except where applicable law expressly permits it.
• Impersonate Real Estate Network Inc, its employees, agents, brokers, partners, or other users.
• Misrepresent your identity, qualifications, ownership interest, or authority concerning a property.
• Submit fraudulent property information.
• Manipulate listings, reviews, ratings, or other content.
• Use the Services to discriminate unlawfully in housing-related activities.
• Use contact information obtained through the Services to send unlawful or unsolicited communications.
• Attempt to circumvent security, rate limits, access controls, or other technical restrictions.
• Use the Services to develop or train a competing service where doing so violates applicable rights or restrictions.

11. Intellectual Property

Unless otherwise stated, the Services and their original content, functionality, design, graphics, software, trademarks, logos, text, compilation, arrangement, and other materials are owned by or licensed to Real Estate Network Inc and are protected by applicable intellectual property laws.

Subject to these Terms, Real Estate Network Inc grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for their intended purpose.

This permission does not transfer ownership of any Real Estate Network Inc intellectual property to you.

Third-party trademarks, logos, photographs, listing content, MLS data, and other materials remain the property of their respective owners.

12. Third-Party Services and Links

The Services may contain links, integrations, advertisements, maps, payment services, scheduling tools, mortgage tools, analytics services, social-media features, MLS data, or other functionality provided by third parties.

Real Estate Network Inc does not control and is not responsible for third-party websites, services, products, policies, security practices, content, or availability.

Your use of third-party services may be subject to separate terms and privacy policies. You should review those terms before providing personal information or entering into a transaction.

13. Electronic Communications

By interacting with Real Estate Network Inc electronically, you consent to receive electronic communications where permitted by applicable law.

Communications may include account notices, transaction-related messages, service updates, appointment confirmations, property alerts, requested information, and other communications related to your use of the Services.

You may be able to opt out of certain promotional communications using the unsubscribe mechanism included in those communications.

Opting out of promotional communications will not necessarily prevent us from sending important service, account, security, legal, or transaction-related communications.

14. Text Messaging

If you separately opt in to receive text messages from Real Estate Network Inc, you agree that message frequency may vary and that message and data rates may apply depending on your mobile carrier and plan.

You may opt out of recurring marketing text messages by following the instructions provided in the relevant message, where applicable.

Consent to receive marketing text messages is not a condition of purchasing, selling, renting, or leasing a property.

15. Artificial Intelligence and Automated Tools

Real Estate Network Inc may use artificial intelligence, machine learning, automated decision-support systems, chatbots, recommendation systems, property-search algorithms, valuation tools, or other automated technology (“Automated Tools”) within the Services.

Automated Tools may generate summaries, recommendations, estimates, responses, classifications, property descriptions, or other information based on available data.

Automated information may be incomplete, inaccurate, outdated, or inappropriate for your specific circumstances.

You should not rely solely on an Automated Tool when making a decision involving a purchase, sale, lease, financing, valuation, legal obligation, insurance decision, investment, or other material financial decision.

Where appropriate, independently verify information and consult a qualified professional.

16. Fair Housing and Non-Discrimination

Real Estate Network Inc supports equal housing opportunity and prohibits unlawful discrimination in connection with housing-related services.

Users may not use the Services to facilitate discrimination or otherwise violate applicable fair-housing, human-rights, civil-rights, or anti-discrimination laws.

Property searches, recommendations, advertising tools, audience targeting, and other features are not intended to encourage unlawful discrimination.

17. Accessibility

Real Estate Network Inc is committed to making its digital services accessible to as many people as reasonably possible.

If you encounter an accessibility barrier, please contact us and describe the issue, the page or feature involved, and any assistive technology you were using, if known.

We will consider reasonable requests for assistance and accessibility accommodations consistent with applicable law.

18. Privacy

Your use of the Services is also subject to Real Estate Network Inc’s Privacy Policy.

19. Security

Real Estate Network Inc uses reasonable administrative, technical, and organizational measures designed to protect the Services and information maintained through them.

However, no website, application, network, storage system, or method of electronic transmission can be guaranteed to be completely secure.

You agree not to attempt to bypass or defeat security mechanisms or access systems, accounts, or information that you are not authorized to access.

20. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ALL INFORMATION, CONTENT, DATA, LISTINGS, TOOLS, FEATURES, AND MATERIALS PROVIDED THROUGH THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

REAL ESTATE NETWORK INC DISCLAIMS, TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, RELIABILITY, AND QUIET ENJOYMENT.

Real Estate Network Inc does not warrant that:

• The Services will always be available.
• The Services will operate without interruption.
• The Services will be free from errors or security vulnerabilities.
• Property information will always be accurate or current.
• Listings will remain available.
• Any property will meet your requirements.
• Any transaction will close successfully.
• Any third-party service will remain available.
• Any estimate, recommendation, valuation, forecast, or automated output will be accurate.

Nothing in these Terms excludes a warranty or right that cannot legally be excluded under applicable law.

21. Limitation of Liability

To the maximum extent permitted by applicable law, Real Estate Network Inc and its owners, officers, directors, employees, agents, affiliates, licensors, vendors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of, or inability to use, the Services.

This includes, without limitation, losses relating to lost profits, lost revenue, lost opportunities, loss of data, business interruption, property transactions, financing decisions, reliance on listing information, or interactions with third parties.

To the maximum extent permitted by applicable law, Real Estate Network Inc’s aggregate liability arising from or relating to the Services or these Terms will not exceed the greater of:

1. The amount you paid directly to Real Estate Network Inc for the applicable Services during the twelve months preceding the event giving rise to the claim; or
2. One hundred U.S. dollars (US $100).

The limitations above do not apply where prohibited by applicable law.

22. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Real Estate Network Inc and its owners, officers, directors, employees, agents, affiliates, contractors, licensors, and service providers from claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

• Your violation of these Terms.
• Your misuse of the Services.
• Your User Content.
• Your violation of another person’s rights.
• Your violation of applicable law.
• Your fraudulent, negligent, or intentionally wrongful conduct.
• Your real estate transaction or dealings with third parties.

23. Suspension and Termination

Real Estate Network Inc may suspend, restrict, or terminate your access to some or all of the Services if we reasonably believe that you have violated these Terms, applicable law, or another agreement with Real Estate Network Inc.

We may also modify, suspend, discontinue, or replace portions of the Services at any time.

Where reasonably practical, Real Estate Network Inc may provide notice before taking action. However, we may act immediately where necessary to protect users, Real Estate Network Inc, third parties, property data, systems, or legal rights.

Provisions that by their nature should survive termination will survive, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution, and applicable law.

24. Changes to These Terms

Real Estate Network Inc may update these Terms from time to time to reflect changes in our Services, business practices, technology, applicable law, or other circumstances.

When we make material changes, we may provide notice through the Services, by email, or by another reasonable method.

The updated Terms will become effective on the date specified in the revised Terms.

Your continued use of the Services after the effective date of revised Terms constitutes acceptance of the revised Terms to the extent permitted by applicable law.

25. Governing Law and Disputes

These Terms will be governed by the laws of [STATE/PROVINCE AND COUNTRY], without regard to conflict-of-law principles, except to the extent superseded by applicable federal or other mandatory law.

Before filing a formal legal claim, the parties agree, where permitted by law, to make a good-faith effort to resolve the dispute informally.

Any arbitration, class-action waiver, venue requirement, or other dispute-resolution provision should be inserted here only after review by qualified counsel, because enforceability varies significantly by jurisdiction and circumstance.

26. General Provisions

Severability

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

No Waiver

Real Estate Network Inc’s failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.

Assignment

You may not assign or transfer your rights or obligations under these Terms without Real Estate Network Inc’s prior written consent. Real Estate Network Inc may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or similar transaction.

Entire Agreement

These Terms, together with any additional terms expressly incorporated into them and any applicable written agreements between you and Real Estate Network Inc, constitute the agreement governing your use of the Services.

Force Majeure

Real Estate Network Inc will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, widespread internet or telecommunications failures, governmental action, labor disputes, war, civil unrest, cyberattacks, infrastructure failures, or other events beyond our reasonable control.

Section headings are provided for convenience and do not affect the interpretation of these Terms.
